These terms and conditions (”Terms”) apply to any order placed with Hidden Pte Ltd (”us”, “our”, “we”, or “Hidden”) by customer (”you”, “your”, or “Customer”) for our Hidden Singapore games, and forms part of the contract between Hidden and Customer (“Party” or “Parties”) in respect of the products or services to be provided by Hidden to Customer. These Terms are governed under the laws of Singapore. If you are a corporate customer, it is your responsibility to ensure that the participants agree to these Terms before taking part.
Intellectual property rights
We own or have a licence to the intellectual property rights in and to our website and our products and services (including our user interface, and the game and event materials and experience). You must not reproduce, reverse engineer, modify, decompile, disassemble, republish, recreate, copy, replicate, distribute or make commercial use of any of our IP including any material / content from our website or products or services except with our written permission.
We will continue to own the intellectual property rights to any customisations, improvements or modifications to our products/services (even if based on Customer request), other than where your assets are used (for example, your company logo) – in such event, you agree to grant us a non-exclusive licence to use these assets for the purposes of providing you with the customised product/service (e.g., leaderboard).
As part of the product/service, you may provide reviews or testimonials, or upload photos, videos or other media on WhatsApp, our website and/or other platforms like social media channels. You grant us a perpetual royalty-free licence to use such materials and media in our marketing activities - you can revoke this at any time by notifying us that you wish for us not to use the content provided by you.
Refunds/exchange policy
All tickets purchased and orders placed are non-refundable. In the event that a game is cancelled or postponed for reasons beyond our control, no refunds will be offered however we will endeavour to put in place alternative workarounds such as organising an alternative date or providing for exchanges to other products/services. If the event is cancelled for reasons within our control, refunds are offered strictly at our discretion. Liability
Each Party’s liability for all contractual and non-contractual claims shall be limited to the fees paid by you to us under this contract, provided that such liability cap does not apply to any breach of the intellectual property rights provisions set out in these Terms.
To the maximum extent permitted by law, we shall not be liable for any liability for death or personal injury, physical damage or damage to any persons or property. We shall not be liable for any loss of profits, loss of business, loss of anticipated savings, or any special, indirect or consequential losses.
Our products/services are provided on an “as is” and “as available” basis and we make no representations or warranties (express or implied) about our products/services. We shall not be liable for any losses arising directly or indirectly in connection with our products/services. Where our products/services require physical activity, we advise pregnant women or individuals with health issues or accessibility requirements to obtain medical advice or make their own assessments prior to participating in any of our products/services.
Events outside our control
We shall not be liable for any non-performance, error, interruption or delay in performing any obligations under the contract for any force majeure events or events which are beyond our reasonable control (including poor weather conditions, natural disasters, government instructions).
Third party vendors
Our product/service relies on third-party vendors and applications such as WhatsApp and other technology providers, and as such, there may be interruptions in the product/service which may arise outside our control. We will endeavour to solve any interruptions as quickly as we can. If any such interruption continues for 30 minutes, we will discuss alternative options with you such as rescheduling the event or providing a refund. Please note that agreement to any workarounds is solely at our discretion.
Third party venues
While most of our games are in public and open spaces, some of our products/services are located in private spaces including commercial properties. Access to such private spaces is subject to any relevant terms and conditions as imposed by such private spaces.
Data privacy
Where you are providing personal data to us, you confirm that you have consented to, or where the third party is not your own, you have obtained the appropriate consents to provide such data to us for processing in accordance with our Privacy Policy.
